Timothy Michael Brind Jr., identified as the driver involved in the Aug. 22 traffic accident that resulted in the death of Kent State student Colin Pho, was indicted Feb. 17 for “failure to stop after an accident” by a Portage County Grand Jury.

Failure to stop after an accident that results in the death of a person is a third-degree felony, which typically carries a prison sentence of up to 36 months and a potential $10,000 fine.

Brind, of Atwater, Ohio, is not yet charged with the felony. Fleeing the scene of an accident is considered an automatic crime in the state of Ohio. A warrant was issued for Brind’s arrest Feb. 17.

The indictment comes nearly six months after Pho’s death. Pho was a 22-year-old computer science major with a minor in theater. He was traveling eastbound on Summit Street near Dix Stadium on his electric scooter when Brind’s car struck him, according to the crash report from the Ravenna Post of the Ohio Highway Patrol.

Brind, 19, fled the scene, police said. The indictment states Brind failed to stop at the scene of the accident, remain at the scene or alert police.

Before the indictment was made, Jonathan Pho, Colin’s father, said he wanted increased warnings about the dangers of electric scooters and for Summit Street to be made more pedestrian friendly.

“Hopefully if this indictment goes to decision of guilty […] some legislation to make a warning to the public that electric scooters need to have more safety precautions [will be passed],” Pho said. “We will definitely like to have change occurring after this indictment, not for the sentence, just to make the public aware that electric scooters are not safe.”
